"HASH" shall mean HASH, Inc., its affiliates, subsidiaries, and any legal successors.
"HASH-O" shall mean the "Open" version of the HASH product described in the
HASH Developer Docs available at https://hash.dev/docs.
"HASH-O License" shall mean the applicable open-source license available directly
at or via https://hash.dev/license.
"HASH Subscription" shall mean a valid, active subscription agreement with HASH
for the correct number of user seats and instances as defined in the HASH
Subscription Agreement, linked to from https://hash.ai/legal.
"HASH Terms" shall mean the HASH Global Terms of Service, available at
https://hash.ai/legal/terms.
“Legal Entity” shall mean the union of the acting entity and all other entities that control, are controlled by, or are under common control with that entity. For the purposes of this definition, “control” means (i) the power, direct or indirect, to cause the direction or management of such entity, whether by contract or otherwise, or (ii) ownership of fifty percent (50%) or more of the outstanding shares, or (iii) beneficial ownership of such entity.
“License” shall mean the terms and conditions for use, reproduction, and distribution as defined by Sections 1 through 4 of this document.
“Licensor” shall mean the copyright owner or entity authorized by the copyright owner that is granting the License.
"Software" shall mean any software and associated documentation files covered by this License.
“You” shall mean an individual or Legal Entity exercising permissions granted by this License.
With regard to the Software:
2.1. This Software may only be used in production, if You have agreed to, and are in compliance with, the HASH Terms, or other agreement governing the use of the Software, as agreed by you and HASH, and otherwise have a valid HASH Subscription.
2.2. Subject to section 2.1, you are free to modify this Software and publish patches to the Software. You agree that HASH and/or its Licensors (as applicable) retain all right, title and interest in and to all such modifications and/or patches, and all such modifications and/or patches may only be used, copied, modified, displayed, distributed, or otherwise exploited with a HASH Subscription.
2.3. Notwithstanding the foregoing sections, you may copy and modify the Software for development purposes, without requiring a HASH Subscription. You agree that HASH and/or its licensors (as applicable) retain all right, title and interest in and to all such modifications.
2.4. You are not granted any other rights beyond what is expressly stated herein. Subject to the foregoing, it is forbidden to copy, merge, publish, distribute, sublicense, and/or sell the Software.
2.5. You may not move, change, disable, or circumvent the license key functionality in the software, and you may not remove or obscure any functionality in the software that is protected by the license key.
2.6. This License applies only to the part of this Software that is not distributed as part of HASH-O. Any part of this Software distributed as part of HASH-O or is served client-side as an image, font, cascading stylesheet (CSS), file which produces or is compiled, arranged, augmented, or combined into client-side JavaScript, in whole or in part, is copyrighted under the HASH-O License.
2.7. For all third party components incorporated into the Software, those components are licensed under the original license provided by the owner of the applicable component.
3.1. The full text of this License shall be included in all copies of the Software, or incorporated into copies of any substantial part of the Software.
3.2. If you modify the Software, you must include in any modified copies
of the Software prominent notices stating that you have modified the Software,
with a link back to the HASH website (https://hash.ai/).
