EXPLANATORY MEMORANDUM

This Act amends the Pension Rights of Judges Act, Cap. P5, Laws of the Federation of Nigeria, 2004 by expanding the meaning of a judicial official to cover the offices of the Chief Judge or Judge of the Federal High Court, President or Judges of the National Industrial Court and Chief Judge or Judges of the High Court of the Federal Capital Territory.

PENSION RIGHTS OF JUDGES (AMENDMENT) ACT, 2016

An Act to amend the Pension Rights of Judges Act, Cap. P5, Laws of the Federation of Nigeria, 2004 by expanding the meaning of a judicial official to cover the offices of the Chief Judge or Judge of the Federal High Court, President or Judges of the National Industrial Court and Chief Judge or Judges of the High Court of the Federal Capital Territory, Abuja; and for related matters.

ENACTED by the National Assembly of the Federal Republic of Nigeria—

Amendment of Cap. P5 LFN, 2004

  1. The Pension Rights of Judges Act Cap. P5, Laws of the Federation of Nigeria, 2004 (in this Act referred to as “the Principal Act”) is amended as set out in this Act.

Amendment of section 4

  1. Section 4 of the Principal Act is amended by substituting for the definition of “judicial officer”, a new definition—

“judicial officer” means the holder of the office of the Chief Justice of Nigeria or a Justice of the Supreme Court, the President or Justice of the Court of Appeal, the Federal High Court, the office of the President or Judges of the National Industrial Court, the office of the Chief Judge or Judge of the High Court of the Federal Capital Territory, Abuja, the office of the Chief Judge of a State or Judge of the High Court of a State, a Grand Kadi of the Sharia Court of Appeal of the Federal Capital Territory, Abuja, a President or a Judge of the Customary Court of Appeal of the Federal Capital Territory, Abuja, a Grand Kadi of the Sharia Court of Appeal of a President or Judge of the Customary Court of Appeal of a State and a reference to a “judicial officer” is a reference to the holder of such office”.

Citation.

  1. This Act may be cited as the Pension Rights of Judges (Amendment) Act, 2016.

I, CERTIFY, IN ACCORDANCE WITH SECTION 2 (1) OF THE ACTS AUTHENTICATION ACT CAP. A2, LAWS OF THE FEDERATION OF NIGERIA 2004, THAT THIS IS A TRUE COPY OF THIS BILL PASSED BY BOTH HOUSES OF THE NATIONAL ASSEMBLY.
